The Principal Designer Role (Building Regulations)

By September 12th, 2025No Comments

Introduction

The Building Regulations in the UK ensure that buildings are designed and constructed to meet specific standards of safety, accessibility, and sustainability. For commercial fitout projects, understanding the role of the Principal Designer is crucial to ensure compliance and project success. This post outlines the key aspects of this important role and what clients need to know.

When do the regulations apply?

The Building Regulations apply to most construction projects, including:

  • New building construction
  • Significant alterations to existing buildings
  • Commercial fitout projects that involve structural changes
  • Projects that affect fire safety measures
  • Changes to building services (electrical, plumbing, ventilation)

Even seemingly minor commercial fitout work may fall under these regulations if it involves changes to the building’s structure, fire compartmentation, means of escape, or accessibility features.

The Principal Designer Role

The Principal Designer (PD) is a key role introduced under the Construction (Design and Management) Regulations 2015 (CDM 2015). Their primary responsibilities include:

  • Planning, managing, and coordinating health and safety during the pre-construction phase
  • Identifying and eliminating or controlling foreseeable risks
  • Ensuring designers carry out their duties
  • Liaising with the Principal Contractor regarding ongoing design matters
  • Preparing and providing relevant information for the health and safety file

For commercial fitout projects, the Principal Designer helps ensure that design decisions consider both aesthetic requirements and regulatory compliance, creating spaces that are not only functional and attractive but also safe and accessible.

Client Duties

As a commercial client commissioning a fitout project, you have specific legal responsibilities:

  • Appointing a competent Principal Designer (and Principal Contractor) in writing
  • Ensuring sufficient time and resources are allocated for all stages of the project
  • Providing relevant information to your project team
  • Ensuring a Construction Phase Plan is drawn up before work begins
  • Ensuring suitable welfare facilities are provided
  • Maintaining and providing access to the Health and Safety File upon project completion

Working with an experienced Principal Designer early in your project ensures that regulatory requirements are addressed from the outset, potentially saving time and costs by avoiding late-stage design changes to achieve compliance.

By understanding and fulfilling these responsibilities, commercial clients can ensure their fitout projects proceed smoothly, safely, and in full compliance with the Building Regulations.
